Article 1. Applicability
1.1 These Terms and Conditions apply to all offers, orders, agreements, products and services provided by Bluebird Guitar Straps.
1.2 By placing an order, accepting an offer, or using the webshop of Bluebird Guitar Straps, the customer agrees to these Terms and Conditions.
1.3 Any deviations from these Terms and Conditions are only valid if confirmed in writing by Bluebird Guitar Straps. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.
1.4 These Terms and Conditions also apply to any third parties engaged by Bluebird Guitar Straps in the execution of orders, agreements, deliveries or services.
Article 2. Offers and Agreements
2.1 All offers, product information and prices displayed by Bluebird Guitar Straps are non-binding and subject to change. Bluebird Guitar Straps reserves the right to correct pricing errors, product information or other mistakes at any time.
2.2 An agreement between the customer and Bluebird Guitar Straps is concluded once an order has been accepted and confirmed by Bluebird Guitar Straps.
2.3 Bluebird Guitar Straps reserves the right to refuse or cancel orders in the event of pricing errors, suspected fraud, unavailable products, shipping restrictions or other reasonable circumstances. If an order cannot be accepted, the customer will be informed as soon as reasonably possible.
Article 3. Prices and Payments
3.1 All prices displayed by Bluebird Guitar Straps are listed in Euro (€) and include VAT where applicable, unless stated otherwise. Shipping costs, import duties, local taxes or additional charges may apply depending on the destination country and remain the responsibility of the customer unless stated otherwise.
3.2 Payment must be made using one of the payment methods offered during the checkout process. Orders will only be processed after payment has been successfully received by Bluebird Guitar Straps.
3.3 In the case of payment by bank transfer, the payment date shall be the date on which the payment is received in the bank account of Bluebird Guitar Straps.
3.4 Bluebird Guitar Straps reserves the right to suspend, refuse or cancel an order or agreement if payment has not been completed, has been reversed, or if fraudulent activity is suspected.
Article 4. Warranty
4.1 Bluebird Guitar Straps guarantees that its products are delivered in good condition and are free from manufacturing defects at the time of delivery.
4.2 All products are covered by the applicable statutory warranty rights under Dutch and European consumer law.
4.3 The warranty does not cover normal wear and tear, damage caused by improper use, misuse, modifications, accidents, exposure to moisture, or damage caused by incorrect installation or handling of the product.
4.4 Due to the handmade nature and use of vintage or custom-woven materials, slight variations in color, texture, pattern or finishing may occur and shall not be considered defects.
4.5 Products made using vintage materials may contain small irregularities, variations or signs characteristic of the original woven materials and craftsmanship.
Article 5. Delivery
5.1 Bluebird Guitar Straps aims to process and ship in-stock products within 2–4 business days after payment has been received, unless stated otherwise on the webshop.
5.2 Products that are custom-made, temporarily out of stock or made-to-order may require additional processing time. Estimated delivery times are indicative and may vary depending on product availability, production schedules and shipping destination.
5.3 Bluebird Guitar Straps works with external shipping carriers and postal services. Delivery times are therefore estimates and may be affected by customs procedures, carrier delays, force majeure or other circumstances beyond our reasonable control.
5.4 If an order cannot be shipped within a reasonable timeframe, the customer will be informed as soon as reasonably possible.
5.5 Delivery is considered completed once the order has been successfully delivered to the shipping address provided by the customer.
Article 6. Cancellations and Returns
6.1 Customers within the European Union have the right to cancel their order within fourteen (14) calendar days after receiving the product, in accordance with applicable consumer protection laws.
6.2 To exercise the right of cancellation, the customer must notify Bluebird Guitar Straps by email or written notice within the applicable cancellation period.
6.3 Returned products must be unused, undamaged, and returned in their original packaging where reasonably possible. The customer is responsible for the direct cost of returning the product unless otherwise required by law.
6.4 Custom-made, personalized or specially produced products may be excluded from cancellation or return rights where permitted by applicable law.
6.5 If a shipment is refused, unclaimed, or returned due to an incorrect address provided by the customer, Bluebird Guitar Straps reserves the right to deduct any return shipping costs, import charges, customs fees or carrier charges incurred.
Article 7. Retention of Title
7.1 All products supplied by Bluebird Guitar Straps remain the property of Bluebird Guitar Straps until full payment has been received for the relevant order.
7.2 The risk of loss or damage to the products passes to the customer at the moment the order has been delivered to the provided delivery address.
Article 8. Intellectual Property
8.1 All content, product designs, images, logos, branding, photographs, texts and other materials used by Bluebird Guitar Straps are the intellectual property of Bluebird Guitar Straps or its licensors, unless stated otherwise.
8.2 No content or material from Bluebird Guitar Straps may be copied, reproduced, distributed, published or used commercially without prior written permission from Bluebird Guitar Straps.
8.3 Bluebird Guitar Straps respects the intellectual property rights of third parties. If any party believes that their intellectual property rights are being infringed, they may contact Bluebird Guitar Straps directly.
Article 9. Complaints and Liability
9.1 Customers are requested to inspect their order upon delivery and to contact Bluebird Guitar Straps as soon as reasonably possible if a product appears damaged, defective or incorrect.
9.2 If a product is found to be defective or not in conformity with the order, Bluebird Guitar Straps may, at its discretion and in accordance with applicable consumer law, replace the product, repair the product, or issue a refund.
Article 10. Communication and Electronic Orders
10.1 Bluebird Guitar Straps is not liable for delays, communication errors, technical malfunctions, lost data, or failures in electronic transmissions caused by internet services, payment providers, email services, shipping systems or other third-party communication networks, unless caused by intentional misconduct or gross negligence by Bluebird Guitar Straps.
10.2 Electronic communication, including emails and webshop orders, shall be considered valid and legally binding to the extent permitted by applicable law.
Article 11. Force Majeure
11.1 Bluebird Guitar Straps shall not be held liable for delays or failure to fulfill obligations caused by circumstances beyond its reasonable control.
11.2 In the event of force majeure, Bluebird Guitar Straps reserves the right to suspend, delay or cancel orders or agreements without being liable for compensation or damages.
Article 12. Miscellaneous
12.1 The customer is responsible for providing a correct and complete delivery address. Bluebird Guitar Straps is not responsible for delays, losses or additional costs resulting from incorrect address information provided by the customer.
12.2 If Bluebird Guitar Straps does not immediately enforce any provision of these Terms and Conditions, this shall not be interpreted as a waiver of any rights.
12.3 If any provision of these Terms and Conditions is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain fully valid and enforceable.
12.4 Bluebird Guitar Straps reserves the right to engage third parties in the execution of orders, deliveries, payments or other services.
Article 13. Applicable Law and Jurisdiction
13.1 These Terms and Conditions, and all agreements between the customer and Bluebird Guitar Straps, shall be governed by and interpreted in accordance with the laws of the Netherlands.
13.2 Any disputes arising from or related to these Terms and Conditions or agreements with Bluebird Guitar Straps shall be submitted to the competent court in the Netherlands, unless otherwise required by applicable consumer protection law.
Article 14. Privacy and Personal Data (GDPR / AVG)
14.1 Bluebird Guitar Straps processes personal data in accordance with applicable privacy and data protection laws, including the General Data Protection Regulation (GDPR / AVG).
14.2 Bluebird Guitar Straps processes personal data solely for the purpose of processing orders, payments, shipping, customer communication and related webshop services.
14.3 Personal information provided by customers will be handled confidentially and will not be sold or shared with third parties unless necessary for payment processing, shipping services, legal obligations or the execution of an order.
